Participation and game rules

1. Organizer: The organizer of the game presented in these participation and game rules (hereinafter referred to as: Game) is Novaszputnyik Kft. (1074 Budapest, Dohány utca 20. 1/2/2).
2. The Player
2.1. Any person with an Instagram user account can participate in the Game announced by the Organizer.
2.2. Employees of the Organizer and their close relatives are excluded from the game.
3. Game mechanism, conditions of participation:
3.1. The Organizer announces the Game to the Player via the Organizer's official Instagram page ( https://www.instagram.com/szputnyikshop/ ). The prize game is free and does not involve any purchase obligation.
3.2. The competition runs from February 11, 2025 to February 14, 2025 .
3.3. The Prize Draw can be entered by anyone who, during the duration of the draw, establishes a "Follow" relationship with the Organizer's Instagram page called "szputnyikshop" and tags at least 1 friend in the form of a comment written under the post in the Instagram post created for the draw.
3.4. The prize draw will take place on February 14, 2025 at 2 p.m. The Organizer will notify the winner of the draw in an Instagram message and publish the winner's name on the Szputnyik shop Instagram page and/or on its official website ( www.szputnyikshop.hu ). If the Player's notification by the Organizer does not lead to a result within 5 working days of the draw, the Organizer will transfer the prize to the alternate winner in the same manner. The winner will receive the prize by post.
4. Duration of the Game
Game start date: February 11, 2025 12:00
Closing date of the Game: February 14, 2025, 2:00 PM

6. Prize
6.1. In the framework of the draw announced by the Organizer, one winner will be selected who will receive 2 Dickies beanie hats, in green and pink colors.

6.2. The prize is not transferable. The prize cannot be exchanged for cash.
6.3. The Organizer is responsible for paying taxes on the prize.
6.4. In addition to the winner according to point 3.4., the Organizer will draw an additional prize, a total of 1 person.
6.5. The Organizer has no further obligations other than the delivery of the prize as described above and the settlement of tax implications. The Organizer reserves the right to amend or terminate the conditions set out in these rules or the prize game itself during the duration of the game. The Organizer will publish any amendments to the rules or any notice of the possible termination of the prize game on the official Instagram page of Szputnyik shop. It is the responsibility of the participants in the prize game to inform themselves about these. If the winner does not claim the prize within 30 days, the alternate winner of the draw will be entitled to the given prize, who will be notified of his/her prize by the Organizer as described above.
7. Moderation
The Organizer reserves the right to refuse to publish any comments or other content posted by the Player (hereinafter referred to as: User Content), to moderate or remove the User Content. The Organizer further reserves the right to refuse or delete objectionable content and/or any User Content that it finds in its sole discretion to be infringing or inappropriate, and to exclude the Player from the game. The Organizer may retain certain User Content in its sole discretion, and may also disclose User Content if required by law or if the Organizer reasonably believes that it is necessary to protect users or their personal safety. The Organizer excludes liability for any damage or loss arising from the use of any User Content posted or otherwise transmitted on the Organizer’s Instagram page.
8. Conditions for receiving the prize:
The Organizer is not responsible for any damages or consequences caused by incorrect or incorrect data provided by the Player. The Organizer reserves the right to award the prize exclusively to the winner or his/her close relative.
Participants in the game agree that, if they win, their name will be publicly announced on the Organizer's Instagram page and/or the Organizer's website ( www.szputnyikshop.hu ), and/or the official Facebook page ( https://www.facebook.com/szputnyikshop ).
The Winner is obliged to cooperate with the Organizer in the delivery of the prize. The prize can only be collected in person at the Szputnyik Shop (1074, Budapest, Dohány utca 20.).
9. Organizer's rights
The Organizer has no further obligations in relation to the prize, other than the delivery of the prize and the reimbursement of its tax implications. The Organizer excludes its liability for any claim for compensation or indemnity in connection with participation in the Game, and is not liable for any errors in the game or for any costs or damages related thereto. It is also not liable if the Organizer's Instagram page is temporarily unavailable during the duration of the game.
The Organizer reserves the right to change the terms and conditions of the game without informing the participants. The Organizer will publish any changes to the Rules of Participation or any notice of termination of the Game on its official Instagram page.
Participants agree that they are fully responsible for any damage caused to the Organizer by any violation of the Participation Rules during their participation in the Game. In case of violation of the Participation Rules, the player's participation is invalid.
10. Data management
By participating in the Game, the player unconditionally consents to the personal data (name, address, e-mail address, telephone number) provided by the player and the winner being included in the Organizer's database and being used by the Organizer for its own marketing activities without any further compensation or permission. This consent does not extend to the Organizer's disclosure of this data to third parties for use.
The Organizer processes the Players' personal data in accordance with these Participation Rules and the applicable data protection laws.
Novaszputnyik Kft. (1074 Budapest, Dohány utca 20. 1/2/2) , hereinafter referred to as the “Data Controller”) processes your personal data specified in these Participation Rules for the purposes specified in these Participation Rules based on your voluntary, prior and detailed informed express consent. By participating in the Game, you expressly consent to the processing of your personal data specified in these Participation Rules. You expressly accept and acknowledge that you are not entitled to compensation for the public disclosure of your data in connection with the game. Participation in the game and the provision of data are voluntary, however, you acknowledge that if you fail to provide the data necessary for the delivery of the prize in the event of becoming a winner, this will lead to your exclusion from the game, i.e. you will lose your right to the prize.
Scope of personal data processed
For the purposes specified in these Participation Rules, the Data Controller only processes the personal data that you voluntarily provided to the Data Controller during your participation in the game (for example, name, e-mail address, mailing address, telephone number, hereinafter: Personal Data).
Purpose of data processing
The data controller is entitled to process your Personal Data for the purpose of participating in the game, the delivery of the prize, and marketing activities. By participating in the game, the Players also expressly consent to the Organizer using the personal data of the players and winners provided to the Organizer free of charge and legally (e.g., name, address, telephone number, e-mail address, etc.) for the purpose of conducting this Game and the Organizer's marketing activities and contacting the Player in person, by post or via communication means with a direct commercial offer. By participating in the Game, the Player consents to the Organizer repeatedly and continuously contacting him/her for the purpose of market research. The legal basis for the provision of data is the consent given by participating in the Game, and the Player may request information about the data processing at any time. In connection with the processing of data, the participants are entitled to the right to object and the right to enforce their rights in court.
Data controller, data processor
The Data Controller is entitled to process your Personal Data for the purposes specified in these Participation Rules. When processing your Personal Data, the data is processed by Novaszputnyik Kft. (1074 Budapest, Dohány utca 20. 1/2/2) .
Duration of data processing
The Data Controller is entitled to process your Personal Data until you withdraw your consent.
Data security
The Data Controller ensures the security of your Personal Data and implements technical and organizational measures that guarantee an adequate level of protection of your Personal Data.
Withdraw consent
The Data Controller informs you that you may withdraw your consent at any time, without any limitation or justification, free of charge, by sending an e-mail to the following e-mail address (info@szputnyikshop.hu) or by sending a letter to the following mailing address ( Novaszputnyik Kft. (1074 Budapest, Dohány utca 20. 1/2/2) .
11. Legal Remedy
The Data Controller hereby informs you that pursuant to Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information (“Infotv”), and under the conditions specified in the Infotv, you: (i) have the right to request information from the data controller about the processing of your data (ii) may request the correction of your data from the data controller, and in the event of a violation of your rights, you may contact the National Authority for Data Protection and Freedom of Information (1125 Budapest, Szilágyi Erzsébet fasor 22/c.) or a court. The registration number of the Data Controller in the register kept by the National Authority for Data Protection and Freedom of Information is: NAIH-122386/2017.
12. Acceptance of the Participation Rules by the Player
By participating in the game, the Player acknowledges and accepts all the conditions set out in these Participation Rules.
13. Final provisions
The Game is governed by Hungarian law. All data obtained in connection with applications during the Game may only be used in accordance with the consent given by the applicants at the time of application, these Rules of Participation and the Instagram principles.
The Game is not sponsored, endorsed or associated with Instagram. The Player provides their data to the Organizer of the Game, not to Instagram. The information provided by the Player will only be used for the purposes described in these Rules. Instagram is not involved in the organization of the Game, therefore they are fully and completely exempt from any obligations arising from the Game in connection with their participation in the Game.
If any provision of these Participation Rules is invalid, this shall not affect the validity of the remaining parts of the Participation Rules. In such case, the invalid provision of the Participation Rules shall be replaced by the relevant and effective provision of the applicable Hungarian legislation.
